Draw Terms and Conditions
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. BY ENTERING, YOU AGREE TO THESE TERMS AND CONDITIONS, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES
These Draw Terms and Conditions (“Terms”) govern the placing of draw entries ("Entries") with Aimé Leon Dore, Inc. (“we”, “ us”, or “Aimé”) for apparel or other items you attempt to purchase from us ("Products"). Please read these Terms carefully before submitting your Entry of any Aimé Products. By submitting your Entry, you agree to be legally bound by these terms.
1. Start/End Dates.
Draw beginning and end dates will be identified in the applicable marketing email (the “Entry Period”).
2. Entry Information
When placing an Entry for Aimé Products, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Aimé shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.
3. Payment
Your payment method will be authorized for the full Price of the Products at the time of placing the Entry. You will only be charged if and when your Draw Entry has been selected and you have been notified via email, at which point your payment will be captured. If Aimé is unable to commence shipping the Products on or before the one-year anniversary of your placing the Entry, Aimé shall process a full refund to you. Submission of an Entry constitutes your express agreement to Aimé to charge the full Price of the Products at such time. If your entry is not selected, the initial authorization will be released. It can take up to 14 business days for the initial authorization to be removed from your payment method.
4. Limitation of Liability
Under no circumstances will Aimé be held liable for any incidental, special or consequential damages arising out of or related to this agreement. In the event Aimé is held liable for any damages arising out of or related to this agreement, your sole and exclusive remedy will be the full refund of your purchase price without interest.
5. Eligibility
Entry is open only to those who are at least eighteen (18) years of age as of the date of entry. Void where prohibited.
6. Customer Information
We will use any information that we may collect about you only in accordance with our privacy policy.
7. Disclaimer
Aimé disclaims any warranties, express or implied, with respect to the product displayed by Aimé whether before or after you have entered the draw. You understand and agree that the product, its design and technical features are currently under development and that the product that may be available for purchase by you may be materially different from the prototype product.
8. Changes to the Terms
Aimé reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your order for a refund.
9. Additional Conditions
Aimé reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Draw or any Draw Entry should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the draw. In such a case, Aimé will select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Aimé. Aimé reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Draw Entry or website. Aimé may prohibit an entrant from participating in the Draw Entry or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Draw Entry by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Aimé representatives.
10. Miscellaneous Provisions
These Terms constitute the entire agreement between the parties pertaining to its subject matter and it supersedes all prior agreements, representations and understandings of the parties. This Agreement shall be governed by and shall be construed in accordance with the laws of the State of New York. The venue for any actions relating to the subject matter or enforcement of this Agreement shall be in New York, NY, the place where this Agreement was entered and is to be performed. You may not assign this Agreement or any of the rights granted to you hereunder.
11. Winners List
